Complaints, Takedown & Corrections Policy

This Policy explains how Thesis Tracker handles three categories of request: (1) complaints about the Operator or the Service, (2) takedown requests from Fund Managers whose content appears on the Service, and (3) corrections to Content. The Policy is designed to be accessible, fast, and accountable.
1. Our commitment
We take complaints, takedown requests, and corrections seriously. Our commitment is to acknowledge every request promptly, investigate fairly and thoroughly, respond within the timeframes set out in this Policy, act on legitimate concerns without requiring complainants to navigate barriers, and maintain an internal record of every request and its resolution.
2. Which pathway to use
2.1 Complaints
Use the complaints pathway if you wish to raise a concern about the Operator's conduct, the Service's operation, your Account, billing, our handling of your personal information, or any other aspect of your relationship with us. See clause 3.
2.2 Takedowns
Use the takedown pathway if you are a Fund Manager (or an authorised representative of a Fund Manager) and you wish to request removal of Content sourced from your published materials. See clause 4.
2.3 Corrections
Use the corrections pathway if you have identified a factual error in Content — including a factual inaccuracy, a misclassification, or an Entry that fails to faithfully represent the source publication. See clause 5.
3. Complaints
3.1 How to make a complaint
Complaints should be sent to team+complaints@thesis-tracker.com with your name and contact details, a description of the issue, when the issue occurred, any relevant evidence, and the outcome you would like.
3.2 Acknowledgement and timeframes
We will acknowledge your complaint within 5 business days of receipt. We aim to provide a substantive response within 30 calendar days. If a complaint is complex and requires more time, we will tell you within 30 days and provide an estimated timeframe for resolution.
3.3 Internal review
If you are not satisfied with our initial response, you may request internal review. Internal review is conducted by a more senior member of the Operator's team who was not involved in the original response.
3.4 External escalation
If you remain dissatisfied after internal review, the appropriate external pathway depends on the nature of the complaint:

Privacy complaints — Office of the Australian Information Commissioner (oaic.gov.au, 1300 363 992);

Consumer law complaints — the Australian Competition and Consumer Commission (accc.gov.au) or your state Fair Trading office;

Concerns about unlicensed financial services — Australian Securities and Investments Commission (asic.gov.au);
-
Court proceedings — courts of the jurisdiction set out in the Terms of Use.
3.5 No detriment for complaining
We will not suspend, restrict, or terminate your Account, or take any other adverse action, in retaliation for a complaint made in good faith.
4. Takedown requests from Fund Managers
4.1 Right to request removal
Any Fund Manager whose published statements are reproduced or referenced on the Service may request removal of any or all such Content, at any time, without giving reasons.
4.2 How to request a takedown
Takedown requests should be sent to team+request@thesis-tracker.com with the name of the Fund Manager, the name and role of the person submitting the request and confirmation that they are authorised to act for the Fund Manager, the URLs or description of the Entries to be removed, and any preferred scope or conditions.
4.3 Acknowledgement and action
We will acknowledge takedown requests within 1 business day and action them within 5 business days. Where the request is urgent, we will use reasonable endeavours to action the request more quickly.
4.4 Verification
We may take reasonable steps to verify that takedown requests are made by or on behalf of the relevant Fund Manager. We will not delay action on a takedown request beyond what is necessary for verification.
4.5 Scope of removal
On receipt of a valid takedown request, we will remove the requested Content from the live Service, cease indexing further material from the Fund Manager (unless the Fund Manager limits the request to specific Entries), and not republish removed Content without the Fund Manager's written consent.
4.6 No requirement to give reasons
Fund Managers are not required to give reasons for takedown requests. We will not require evidence of copyright ownership, defamation, regulatory concern, or any other basis. The Operator's policy is to respect Fund Manager autonomy over their own published statements.
4.7 Record of takedown
We maintain an internal record of takedown requests, including the date received, the requestor, the scope, the action taken, and the date completed. We do not publish takedown notices unless the requesting Fund Manager asks us to.
5. Corrections
5.1 What constitutes an error
For the purposes of this Policy, an "error" includes:

an incorrect attribution (wrong Fund Manager named);

an incorrect date or source citation;
-
a Verbatim Extract that does not match the source publication exactly;
-
a misclassified action (for example, "Initiated" applied to what was actually an increase to an existing position);
-
an inaccurate factual statement about a listed entity (sector, market capitalisation, identifier);
-
a Topical Sentence or Action Statement that misrepresents what the source publication addresses;
-
a faithfulness failure — an Entry whose Verbatim Extracts omit a material counterbalancing consideration from the source publication, leaving the reader with a one-sided impression of what the Fund Manager said; or
-
any other material inaccuracy.
5.2 How to request a correction
Correction requests should be sent to team+request@thesis-tracker.com with the URL of the Entry containing the error, a description of the error, where possible the correct information and a reference to the source supporting the correction, and your name and contact details.
5.3 Acknowledgement and timeframes
We will acknowledge correction requests within 2 business days. We aim to investigate and respond within 7 calendar days. Substantiated corrections will be implemented as soon as practicable, typically within 24 hours of substantiation.
5.4 Outcome of investigation
Following investigation, we will either correct the Entry and notify the person who reported the error, conclude that no error has occurred and explain our reasoning, conclude that the matter is more appropriately addressed as a takedown (in which case we will refer to the Fund Manager), or seek further information before reaching a conclusion.
5.5 Material corrections notice
Where a correction is material, we will append a brief correction note to the corrected Entry stating the date and nature of the correction.
5.6 Implementing faithfulness corrections
Where a correction relates to a faithfulness failure (clause 5.1(g)), the typical remedy is to add one or more additional Verbatim Extracts to the Entry capturing the material consideration that was omitted, or to replace existing Verbatim Extracts with passages that better reflect the substance of the source publication. Where a faithful Entry cannot be composed, the Entry is removed.
6. Recordkeeping
We maintain an internal register of all complaints, takedown requests, and correction requests, including the date received, the substance of the request, the response, and the outcome. The register is reviewed periodically as part of our compliance program. Records are retained for at least 7 years.
7. Continuous improvement
We review patterns in complaints, takedowns, and corrections at least annually. Where patterns suggest improvements to the Service, the Editorial Policy, or this Policy, we implement those improvements.
